The National HMO Lobby's Ten Point Plan (para 2.10) proposes that all concerned with concentrations of HMOs lobby the government to amend the Use Classes Order, so that planning control can be exercised over HMOs.

Of course, the Lobby itself has done so since we began.  It's encouraging to report that two councils in England have recently resolved to do so too, Bath on 12 October and Southampton on 17 January (though there has been some debate over the exact wording of the latter).

MOTION 15A (as amended) Submitted by Councillor Mizon

HMOs AND TOWN AND COUNTRY PLANNING ACT (USE CLASSES ORDER) 1995

It is recommended that the Council resolves:-

  • to request the Leader of the Council to urge the Rt Hon Ruth Kelly MP, Secretary of State for Communities and Local Government, to amend the Town and Country Planning Act (Use Classes Order) 1995 to remove Class 3 (b) and give consideration to changes to the general permitted development order to control group occupation of dwellings; 

  • to request the Leader of the Council to write to the Local Government Association to lobby for support to amend the Town and Country Planning Act (Use Classes Order) 1995 by removing Class 3 (b) and give consideration to changes to the general permitted development order to control group occupation of dwellings;  and 

  • to request the Leader of the Council to write to local MPs and Opposition Housing spokespersons asking for their support on this issue;

  • to urge the Executive to bring forward for debate a policy to promote and to protect and to enhance family housing in the City.
